Taxpayer can get a Copy of the Fraudulent Return Filed in Their Name

As of approximately June of 2015, Taxpayers have had the right to obtain a copy of a fraudulent tax return filed in their name under the Fraudulent Return Request (FRR) program.  To obtain a copy of the fraudulent tax return the taxpayer MUST mail a letter to the IRS containing the following:

  • The taxpayer’s name, SSN , mailing address and  the tax year of the fraudulent return;
  • The letter must contain the statement “I declare that I am the taxpayer.”;
  • Provide a copy of a government issued ID, and;
  • Form 4506-F, which can be obtained via www.irs.gov

What to Expect

The IRS has 30 days from the date of the request to acknowledge receipt and 90 days to fulfill the request.  The IRS will redact the return making the benefit of the copy somewhat limited.  The IRS will also not provide a redacted copy of the fraudulent return for any open identity theft case.
