I Received an IRS CP 75B Audit Notice, Can You Help?

IRS uses CP75B Audit Initial Contact Letter- Earned Income Credit, Residency to notify you that the IRS is examining your return due to problems with the Earned Income Credit (EIC. As part of the audit, the IRS is requesting additional information verifying that the dependent(s) claimed, lived with the taxpayer for more than half of the year. A portion or all of the taxpayer’s refund is being held until this examination is completed.

What You Need to Do?

Read the notice and the enclosed forms carefully. They explain the information you must send to the IRS

Review the rules for claiming EIC and make sure your child meets the relationship, age, residency, and joint return tests to qualify for the credit. Read more about the qualifying child rules.

Find out if you can claim EIC if you don’t have a qualifying child. Find the rules for those without a qualifying child here.

Provide copies of the documentation the IRS requests to verify the items the IRS is auditing.

Complete the Response form by showing which items your supporting documentation addresses and return the form with the documents you are submitting.

While we always suggest that you contact your tax preparer when dealing with these matters; in the event that you do agree to the notice you can pay the full amount with your Response form. The IRS also provides installment plans if you cannot pay the full amount.

If you disagree with the notice, then it is your job to prove your case. This includes providing an explanation of your position and providing sufficient evidence or documentation.

Failure to respond to the initial notice or provide sufficient documentation to support your disagreement will result in a Statutory Notice of Deficiency, and the assessment of a tax debt.
