Can my kids private school expense be included in an OIC?

Private Schools and OIC.

No, the IRS will generally not allow private school tuition as an allowable expense in an Offer in Compromise. Unless you can prove that a private school is necessary for special educational needs for special needs children or other special needs.  We have gotten this approved but it required a lot work and special documentation.  Basically, you must prove that your child needs could not be provided for with public education.
