Is It Possible to Face Jail Time for Unfiled Tax Return?

The United States doesn’t typically throw people into jail because they cannot afford to pay taxes. However, you may face jail time for committing tax evasion fraud or do not file taxes. While uncommon, you may face a year in jail for each year you did not file.

Substitute Tax Return

If a person repeatedly fails to respond and does not file, the IRS may create a “substitute for return” (SFR) for the taxpayer. The IRS calculates this substitute tax return based on IRS transcripts listing wages and other employer-reported income, income reported by financial institutions, and other third-party agencies. The IRS will factor in the tax, penalty, and interest owed by the taxpayer.

This “substitute for return” (SFR) will likely not be tied to the taxpayer’s actual filing status and will offer very little regarding the taxpayer’s credits, deductions, and exemptions.

As a result of this SFR, the IRS will issue a Notice of Deficiency CP3219N (90-day letter) with the proposed new tax assessment. The taxpayer has only 90 days to file their past due tax return or file a petition in Tax Court. The IRS will proceed with the proposed new tax assessment if they do neither.

If the IRS does file a substitute return, it is in the taxpayer’s best interest to file an original return as a dispute to the Notice of Deficiency CP3219N (90-day letter). This allows the taxpayer to take advantage of any exemptions, credits, and deductions to which they are entitled. The IRS will generally adjust their account to reflect the correct figures.

Other Collection Actions

When the IRS prepares an SFR for a taxpayer, it will likely lead to an outstanding tax balance, which, if unpaid, will trigger the collection process. This collections process can include such actions as wage and bank levy or filing a notice of federal tax lien. Taxpayers can find out about resources available if they owe a tax debt and can’t pay all or part of it.

If taxpayers repeatedly do not file, they will likely be subject to additional enforcement measures, such as penalties and/or criminal prosecution.
